1. Definitions
1.1 You/Your means the person contacting IntegrityTeks and/or anyone who authorizes access to the computer system to be serviced.
1.2 We/Us means IntegrityTeks.
1.3 Hardware means any physical equipment directly involved in the performance of data-processing or communications functions.
1.4 Software means the programs, routines, and symbolic languages that control the functioning of the hardware and direct its operation whether owned by customer or licensed directly to customer from a third party.
1.5 Peripheral means any device with an external connection to the computer system such as printers, monitors and scanners.
1.6 Product means any hardware or software.
2. Services
2.1 Your Responsibility: YOU UNDERSTAND AND AGREE THAT PRIOR TO CONTACTING OR ALLOWING US TO PERFORM ANY DIAGNOSTIC OR REPAIR ON YOUR COMPUTER, IT IS YOUR RESPONSIBILITY TO BACK-UP ALL DATA (FILES, SOFTWARE, OR ANY INFORMATION). YOU ACKNOWLEDGE AND AGREE THAT IntegrityTeks SHALL NOT BE RESPONSIBLE FOR ANY LOSS OR CORRUPTION OF DATA.
2.2 Limitations of Service: We reserve the right to decline or discontinue service at any time and issue a partial or full refund. We shall not be responsible for any loss arising from refusal or inability to complete service.
2.3 Authority: You must provide authorized contact person(s) for service approvals. An authorized individual must be present for on-site work. If not available, service may be declined and a displacement fee may apply.
2.4 Access: We must be provided safe and reasonable access to equipment, workspace, and electrical power. Failure to provide access may result in service refusal and/or additional charges.
2.5 Assumptions: We assume all software and accounts are legally licensed unless otherwise disclosed in writing. Devices are assumed to have pre-existing conditions (working or non-working) unless explicitly documented at intake. IntegrityTeks does not certify or guarantee prior operational status unless expressly confirmed in writing.
3. Warranties and Return Policy
3.1 Service Warranty: Service warranty applies for twenty (20) days from invoice date unless otherwise stated. Warranty covers workmanship only and does not guarantee resolution of underlying or unrelated issues.
3.2 Products: Manufacturer warranties apply to hardware/software products. Assistance with claims may be provided at standard labour rates.
3.3 Exclusions: Warranty does not apply to damage caused by misuse, abuse, accidents, electrical issues, unauthorized repairs, modifications, viruses, malware, or use of third-party parts not supplied or installed by IntegrityTeks.
3.4 Loss of Warranty: Any modifications, installations, or servicing performed by parties other than IntegrityTeks may void applicable warranties on affected systems or components.
3.5 Third Party Software: You are responsible for compliance with all software licensing. You confirm you have the right to use any software requested for installation and agree to indemnify IntegrityTeks against any third-party claims.
3.6 Manufacturer Warranty Notice: Certain repair activities may void manufacturer warranties. IntegrityTeks accepts no liability for any resulting warranty loss.
4. Liability
4.1 Release of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE ONTARIO LAW, IntegrityTeks SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR DEVICE FUNCTION ARISING FROM SERVICES PROVIDED.
4.2 Limitation of Remedy: Your sole remedy for any claim shall be limited to the amount paid for services rendered, where legally applicable.
4.3 Pre-Existing Conditions: IntegrityTeks is not responsible for pre-existing faults, latent defects, or hardware failures that may exist before, during, or after service.
4.4 No Guarantee of Repair: While reasonable care is taken, IntegrityTeks does not guarantee that any service, repair, or diagnostic work will resolve the reported issue or restore full functionality.
4.5 Customer-Supplied Parts:
When customer-supplied parts are provided, IntegrityTeks performs installation services only and makes no warranty or guarantee regarding the quality, compatibility, authenticity, functionality, or reliability of such parts. The customer assumes all risks associated with customer-supplied components.
IntegrityTeks is not responsible for defects, failures, incompatibility issues, or damage caused by customer-supplied parts, whether existing before, discovered during, or after installation.
Unless otherwise agreed in writing, IntegrityTeks does not perform full diagnostic verification of the device or customer-supplied parts beyond what is required to complete the requested service.
Additional labour charges may apply for diagnostics, troubleshooting, or corrective work arising from defective or incompatible parts.
4.6 Severability: If any provision of these terms is found unenforceable, the remaining provisions shall remain in full force and effect.
5. Prices and Payments
5.1 Prices: All prices are subject to applicable taxes.
5.2 Payment: Payment is due upon completion unless otherwise agreed. Hardware or software may require prepayment.
5.3 Late Fees: Overdue accounts may be charged interest at a rate of 20% per annum (1.67% per month) after 30 days.
6. Legal Notices
This website and business operate in Ontario, Canada. Any disputes shall be governed by the laws of Ontario.
